New York Wage Theft Protection Solutions

The New York Wage Theft Prevention Act (WTPA) became became effective in April of 2011. This new law requires employers to adopt more demanding pay notification requirements. Employers must now provide, collect and retain signed copies of a Pay and Payday Notice to employees on specific delivery dates

These notices will include information like: 

  1. Rates of pay (including overtime pay rate if applicable)
  2. Pay day
  3. The basis for pay rate ( e.g. hourly, weekly, commission, salary etc.)
  4. Pay frequency
  5. Whether the employer will be claiming some type of allowance (e.g. tips, meal allowance etc.)

New York's WTPA requires that  notices be delivered for employee's signature on these delivery dates:

  1. Annually, between January 1st and February 1st
  2. Upon hire
  3. If there is a change in position and/or pay

Companies that do not comply with these new regulations can face fines of up to $50/week for each employee.
